Ethik-Code der Pro-Teams 2004 und Verschärfung 2006/2007

Am 14. Dezember 2004 beschlossen die Pro-Teams einen Ethik-Code, einen Verhaltenskodex, der über die UCI-Regelungen hinausgeht . Er ist nicht rechtsverbindlich aber die Teams haben bekräftigt, sich daran zu halten. Er ist die Grundlage der im Dezember 2006 vorgenommenen Verschärfungen (s.u.).

Nach dem Eklat der Opercion Puerto um Fuentes, Saiz und Ullrich verschärften die Teamchefs den Code, die Vereinbarungen wurden aber nur mündlich getroffen:

- Danach werden Radprofis, gegen die ein begründeter Dopingverdacht besteht oder gegen die wegen eines solchen Verdachts ermittelt wird, von der ProTour ausgeschlossen.

 

Am Rande der Straßen-WM in Salzburg, September 2006, kam es zu weiteren Verschärfungen, die ab 1.1.2007 in Kraft traten. Die Turbulenzen vor und während der Tour de France um die damit aufgezeigten heftigen Risse innerhalb der Gemeinschaft der ProTour Teams/Pro Teams lassen jedoch nicht erkennen, dass der erweiterte Ethik-Code das Handeln vieler Teams mitbestimmt.

Als Konsequenz aus den Querelen bildete sich die

Im Folgenden die Selbstverpflichtungen der Pro Teams. Sie gelten für ProTour-Teams und alle anderen, die Wild Cards für ProTour-Rennen erhalten:

PRÄAMBEL

Das vorliegende interne Reglement betrifft alle Professional Teams, die Mitglied der AIGCP sind.

 

DAS INTERNE REGLEMENT DER UCI PRO TEAMS

 

Die UCI Pro Tour verpflichten sich:

 

I. Anzuerkennen, dass für Entscheidungen,die Angelegenheiten der UCI Pro Tour betreffen, eine Mehrheit von zehn (10) Stimmen notwendig ist, unabhängig davon, wieviele UCI Pro Teams anwesend sind.

 

II. Die Verträge der Fahrer zu respektieren und der UCI die Vertragsdaten der Fahrer mitzuteilen, damit ein Fahrer unter Vertrag nicht von einerm anderen Team abgeworben werden kann.

 

III. Die Verantwortung dafür zu übernehmen, einen Fahrer, sofort nach Mitteilung eines positiven Tests aus dem Rennen zu nehmen.

 

IV. Den Verhaltenscodex der AIGCP/UCI Pro Teams zu respektieren.

 

V. Den Präsidenten des Rats des Profiradsports (CCP, UCI) zu bitten, die Lizenzierungs-Commission (Commission des Licences) einzuberufen, sobald eine Verletzung des Verhaltenskodexes von Seiten eines Pro Teams vorliegt.

 

VI. Zu einer SELBST-SUSPENDIERUNG (AUTO SUSPENSION):

 

In Fällen, in denen ein Pro Team konfrontiert ist mit mehreren positiven Dopingkontrollen oder mit vorübergehenden Untauglichkeitserklärungen, die gegenüber Fahrern ausgesprochen wurden, wird sich das Team zeitweilig (aus dem Renngeschehen) zurückziehen (um Korrekturmaßnahmen, die es für nützlich erachtet, zu ergreifen).

 

Die Prinzipien der Selbst-Suspendierung:

- Das gesamte Team ist von der Suspendierung betroffen

- Kein Ausstieg aus einem laufenden ProTour-Wettbewerb

 

FALL Nr. 1

 

Wenn innerhalb von 12 Monaten (entsprechend der Konrolldaten):

- 2 Dopingkontrollen positiv ausfallen und/oder Blutkontrollen anormale Werte aufweisen, wird sich das Team für 8 Tage selbst suspendieren ab Kenntnisnahme der 2. Kontrolle

 

Die Auto-Suspension beginnt am 1. Tag des nächsten ProTour Rennen, ausgenommen sind die 3 Großen Rundfahrten (Giro d'Italia, Tour de France, Vuelta a Espania).

 

FALL Nr. 2.

 

Wenn innerhalb der letzten 24 Monate (entsprechend der Kontrolldaten)

- 3 Dopingkontrollen positiv ausfallen und/oder Blutkontrollen anormale Werte aufweisen, wird sich das Team für 4 Wochen selbst suspendieren ab Kenntnisnahme der 3. Kontrolle.

 

Die Auto-Suspension beginnt am 1. Tag des nächsten ProTour Rennens, auch wenn es sich um eine der Großen Rundfahrten handelt.

 

Prinzipien der Auto-Suspension:

- Das gesamte Team ist von der Suspendierung betroffen

- Kein Ausstieg aus einem laufenden ProTour-Wettbewerb

 

 

ÄNDERUNGEN DES REGLEMENTS DER UCI PRO TEAMS

 

Bei der 1. positiven Dopingkontrolle und/oder auffälligen Blutwerten erfolgt eine schriftliche Benachrichtigung entsprechend der CSCS, sie geht an:

- den Manager/Eigner des Teams, an den Inhaber der Lizenz

- den verantwortlichen Team-Mediziner

- den für das Team verantwortlichen sportlichen Dorektor

- den Fahrer im Falle anormaler Blutwerte

 

Bei der 2. positiven Dopingkontrolle und/oder auffälligen Blutwerten innerhalb der letzten 24 Monate erfolgt eine Vorladung vor die Medizinische Kommission der UCI:

- des Managers/Eigners des Teams

- des verantwortlichen Team-Mediziners

- des für das Team verantwortlichensportlichen Direktors

- des Fahreres im Falle anormaler Blutwerte

 

Bei der 3. positiven Dopingkontrolle und/oder auffälligen Blutwerten innerhalb der letzten 24 Monate erfolgt eine Vorladung vor die Medizinische Kommission der UCI:

- des Managers/Eigners des Teams

- des verantwortlichen Team-Mediziners

- des für das Team verantwortlichensportlichen Direktors

 

Bei der 4. positiven Dopingkontrolle und/oder auffälligen Blutwerten innerhalb der letzten 24 Monate erfolgt die sofortige Rückgabe der UCI Pro Lizenz durch den Lizenznehmer an die Kommission (sofern sie noch nicht nach dem 3. Fall zurückgegeben wurde).

 

Bei jeglicher Eingebundenheit eines verantwortlichen Teammitgliedes (Generalmanager/Eigner, sportliche Direktoren, Ass. Sportlicher Direktoren, verantwortliche Mediziner) in Dopingaffairen (nachgewiesene Fakten) werden vor die Medizinische Commission der UCI vorgeladen:

- die betroffene Person und alle anderen, deren Erscheinen die Kommission für wichtig erachtet

- der Generalmanager/Eigner, Inhaber der Lizenz

- der für das Team verantwortliche Sportliche Direktor

- der für das Team verantwortliche Mediziner

 

 

ENTSCHEIDUNGEN DER TEAMS

 

Die Teams bestätigen, dass sie keinen Kontakt haben zu Fahrern, die in Dopingaffairen verstrickt sind und respektioeren wie bisher seit dem 1. Januar 2005 den Verhaltenskodex der UCI Pro Teams.

 

Ab sofort bemühen sich die Teams darum, dass in den Fahrerverträgen eine Klausel aufgenommen wird, wonach die Fahrer bei der ersten Aufforderung durch ihren Arbeitgeber bereit sind, einem DNA-Abgleich zuzustimmen.

 

Ab sofort bemühen sich die Teams darum, dass in den Verträgen der Fahrer eine Klausel aufgenommen wird, wonach die Fahrer gerichtlich belangt und zu Schadensersatz herangezogen werden können, wenn sie dem Ansehen des Teams zuwiderhandeln. (Ein Mustertext wird der Jurist der AIGCP zur Verfügung stellen)

 

Jegliche Person, die durch eine sportliche oder juristische Instanz sanktioniert wurde, weil sie dem Radsport und dessen Partnern Schaden zufügte (durch Doping, Anwendung oder Handel mit Dopingprodukten, ...), kann durch die AIGCP gerichtlich belangt werden, mit dem Ziel Schadensersatz zu erlangen.

PREAMBULE

 

Le présent règlement interne concerne l’ensemble des UCI Pro Teams, membres de l’AIGCP.

 

REGLEMENT INTERNE UCI PRO TEAMS

 

Les UCI Pro Teams s’obligent à:

 

I. Lors de prises de décisions concernant les affaires de l’UCI Pro Tour, respecter la nécessité d’une majorité de dix (10) voix, quel que soit le nombre d’UCI Pro Teams présents.

 

II. Respecter les contrats des coureurs et notamment à prendre connaissance auprès de l’UCI des dates d’échéances des contrats des coureurs, afin de ne pas démarcher un coureur sous contrat avec une autre équipe.

 

III. Prendre la responsabilité de retirer immédiatement d’une épreuve un coureur recevant la communication de son contrôle positif.

 

IV. Respecter le Code de Conduite AIGCP/UCI Pro Teams.

 

V. Demander au Président du Conseil du Cyclisme Professionnel de saisir la Commission des Licences en cas de non respect du Code de Conduite de la part d’un UCI Pro Team.

 

VI. AUTO-SUSPENSION

 

Dans le cas où une UCI Pro Team est confrontée à plusieurs cas de positivité ou inaptitudes prononcées à l’encontre de ses coureurs, l’équipe s’engage à suspendre temporairement son activité (en vue de mettre en place toute mesure correctrice qu’elle jugera utile).

 

Principes de l’auto suspension:

-Toute l’équipe doit être à l’arrêt

-Pas d’abandon de l’équipe durant l’épreuve UCI Pro Tour

 

CAS N° 1

 

Dans les 12 derniers mois (la date des contrôles faisant foi)

 

2 contrôles anti-dopage positifs et/ou contrôles sanguins anormaux

AUTO-SUSPENSION de l’équipe de 8 jours dès la connaissance du 2ème contrôle

 

L’auto suspension commence le 1er jour de la course PRO TOUR suivante, à l’exception des 3 Grands Tours.

 

 

CAS N°2

 

Dans les 24 derniers mois (la date des contrôles faisant foi)

 

3 contrôles anti-dopage positifs1 et/ou contrôles sanguins anormaux2

AUTO-SUSPENSION de l’équipe de 4 semaines dès la connaissance du 3ème contrôle

 

L’auto suspension commence le 1er jour de la course Pro Tour suivante, y compris s’il s’agit d’un Grand Tour.

 

Principe de l’auto suspension

-Toute l’équipe doit être à l’arrêt

-Pas d’abandon de l’équipe durant l’épreuve UCI Pro Tour

 

CHANGEMENTS REGLEMENTAIRES POUR LES UCI PRO TEAMS

 

1er contrôle anti-dopage positif ou 1er contrôle sanguin anormal:

-explications écrites à la CSCS:

-du manager / gérant de l’équipe, propriétaire de la licence

-du médecin responsable de l’équipe

-du directeur sportif responsable de l’équipe

-du coureur en cas de contrôle sanguin anormal

 

2ème contrôle anti-dopage positif et/ou contrôle sanguin anormal dans les 12 derniers mois:

-convocation devant la commission médicale de l’UCI:

-du manager / gérant de l’équipe, propriétaire de la licence

-du médecin responsable de l’équipe

-du directeur sportif responsable de l’équipe

-du coureur en cas de contrôle sanguin anormal

 

3ème contrôle anti-dopage positif et/ou contrôle sanguin anormal dans les 24 derniers mois:

-convocation devant la commission des licences de l’UCI:

-du manager / gérant de l’équipe, propriétaire de la licence

-du médecin responsable de l’équipe

-du directeur sportif responsable de l’équipe

 

4ème contrôle anti-dopage positif et/ou contrôle sanguin anormal dans les 24 derniers mois:

-restitution spontanée par le propriétaire de la licence UCI Pro Team à la Commission, (si celle-ci n’a pas été retirée lors du 3ème incident).

 

 

Pour toute implication d’un membre dirigeant (manager général/gérant, directeur sportif, directeur sportif adjoint et médecin responsable) dans une affaire de dopage (faits avérés):

-convocation devant la commission des licences de l’UCI:

-de la personne concernée et toute personne que la commission jugera utile d’entendre

-du manager général / gérant, propriétaire de la licence

-du directeur sportif responsable de l’équipe

-du médecin responsable de l’équipe

 

DECISIONS DES EQUIPES

 

Les équipes confirment qu'elles ne sont pas en contact avec les coureurs impliqués dans les affaires de dopage, et respecteront, comme depuis le 1er janvier 2005, le code de conduite des UCI Pro Teams.

 

Les équipes s'engagent dès maintenant à intégrer dans les contrats l'accord des coureurs pour la recherche d'ADN, à la première demande de l'employeur.

 

Les équipes s'engagent dès maintenant à intégrer dans les contrats des coureurs, qu'ils pourront être poursuivis devant les tribunaux, en vue d'obtenir des dommages et intérêts, pour atteinte à l'image de l'équipe. (Un texte sera proposé par l'avocat AIGCP).

 

Toute personne sanctionnée par une autorité sportive ou judiciaire, pour des faits constituant une atteinte à l’image du cyclisme et de ses partenaires (dopage, usage et/ou trafic de produits interdits, …) pourra être poursuivie devant les tribunaux par l’AIGCP en vue d’obtenir des dommages et intérêts.



CODE OF CONDUCT FOR UCI PROTEAMS, 2004

Preamble:

 

The UCI ProTeams wish, in drawing up and signing this code of conduct, to indicate clearly their commitment in favour of strict compliance with the rules that keep sport fair.

In this respect, the introduction of the UCI ProTour, with its call for excellence, offers a historic opportunity. The UCI ProTeams underline that the application of the rules of conduct below is in addition to their undertaking of to comply strictly with the rules of the UCI, including in particular the regulations concerning the health of riders (part XIII) and the UCI antidoping regulations (part XIV).

 

The UCI ProTeams undertake to:

 

I. Put health and sporting ethics at the forefront of their activities.

 

II. Respect the principle of fair play and behave with respect to the public, riders, organisers, teams and the national and international bodies.

 

III. Allow riders to do their job in the best possible conditions.

 

IV. Rule out any form of remuneration to the support team and medical staff based on performance or riders' results.

 

V. Ask all riders to notify their employer in writing of the contact details for their personal trainer(s), doctor(s) and any other person outside the team involved in their physical, medical or psychological preparation.

 

VI. Set up an information and prevention system for the riders concerning the dangers involved in doping practices.

 

VII. Remind riders that they must provide precise information on their whereabouts to any body empowered under the World Antidoping Code that requests it, so that unannounced anti-doping tests can be carried out at any time.

 

VIII. Without prejudice to the right to terminate the contract for serious misconduct, not to enter any licence-holder for events who is subject to disciplinary proceedings for a breach of the UCI antidoping regulations, by any competent body under the World Antidoping Code.

 

IX. Without prejudice to the right to terminate the contract for serious misconduct, not to enter any licence-holder for events who is subject to judicial proceedings or investigation for facts relating to sporting activity, or any act constituting a breach of the UCI antidoping regulations, or any other intentional criminal act.

 

1. as from the opening of the investigation or proceedings:

· if the facts are admitted by the party in question, or

· if information from an official source available to the UCI ProTeam

shows that the facts in question cannot be seriously contested;

 

2. in other cases, as from the date of referral by the investigating body or, where no such procedure applies, the date of the summons to the accused to appear before the trial judge for sentencing.

 

X. If the facts referred to in article IX are the subject of a disciplinary proceedings covered by article VIII, only article VIII shall apply. However, if following the disciplinary proceedings the party involved is required to appear before the trial judge, he shall not be entered for events from one month before the disciplinary hearing until the date of the judgement.

If under the applicable law the disciplinary proceedings have to be suspended because of judicial proceedings covered by article IX, the accused will not be entered for events from one month before the disciplinary hearing and until the date of the decision.

 

XI. Dismiss, in compliance with the national law applicable to the contract, any rider or other member of the team found guilty of a breach of the UCI antidoping regulations, by any sporting or judicial body, or found guilty by a judicial body of a deliberate criminal offence in connection with sporting activity. This rule shall not apply to cases covered by the second paragraph of article XII. The right of dismissal for any valid reason shall remain reserved.

 

XII. For a period of four years after the judgement, not to contract in the team any person who has been found guilty of a fact constituting an intentional violation of the UCI antidoping regulations. For the purposes of the present document, the following shall not be considered as intentional violations:

 

a. offences for which the person is found guilty under article 262 of the UCI antidoping regulations (specific substances);

 

b. offences for which article 264 or 265 of the UCI antidoping regulations have been applied (absence of fault or negligence or of significant fault or negligence) ;

 

c. offences for which article 266 of the UCI antidoping regulations has been applied, except where the person is found guilty of an offence relating to article 15.6.2 (possession by supporting staff), 15.7 (trafficking) or 15.8 (administration to a rider). (The references to the numbering of articles of the anti-doping regulations relate to the version in force in 2005);

 

d. any other offence for which the party involved produces plausible evidence before the president of the Licence Commission that it was unintentional.

 

The present rule shall apply to any disciplinary findings on or after 1 January 2005. The following shall not be taken into account:

 

· an appeal ruling where an initial ruling was made before 1 January 2005 ;

· a disciplinary ruling where a legal judgement has been made before 1 January 2005 ;

· a legal judgement where there has been a disciplinary ruling before 1 January 2005.

 

XIII. Any problems with the application of articles VIII to XII shall be submitted to the president of the Licence Commission or such replacement as he may appoint, whose decision shall be definitive and enforceable and shall not be subject to any appeal.
